By accessing our website, purchasing tickets, attending an event, or using any services provided by Marvyn's Magic Theater (“Theater”), you agree to the following Terms of Service and Conditions.
Admission
All guests must possess a valid ticket and comply with Theater policies, posted rules, and staff instructions. The Theater reserves the right to refuse admission or remove any person whose conduct is deemed disruptive, unsafe, unlawful, or inappropriate.
Ticket Sales and Refunds
Unless otherwise required by law or expressly stated otherwise, all ticket sales are final. Tickets are non-refundable unless otherwise stated.
Seating
Reserved seating is subject to availability. The Theater reserves the right to relocate guests when necessary due to operational, technical, accessibility, or safety requirements.
Performance Changes and Cancellations
The Theater reserves the right to substitute performers, modify programming, reschedule performances, or cancel events due to circumstances beyond its control.
If a performance is canceled and not rescheduled, ticket holders may receive a refund or credit at the Theater's discretion and subject to applicable law.
Late Arrivals
Late-arriving guests may be admitted at an appropriate break in the performance and may not be seated immediately upon arrival.
Guest Conduct
Guests who engage in disruptive, abusive, intoxicated, threatening, unsafe, or unlawful behavior may be removed from the premises without refund.
Photography, Recording, and Livestreaming
Photography, video recording, audio recording, livestreaming, or other reproduction of performances may be prohibited unless expressly authorized by the Theater.
Unauthorized recording may result in removal from the venue without refund.
Promotional Use of Likeness
By entering the Theater, guests grant permission for their image, likeness, voice, or appearance to be photographed, filmed, or otherwise recorded for promotional, marketing, advertising, archival, or other lawful business purposes without compensation.
Accessibility
Guests requiring accommodations should contact the Theater in advance so reasonable accommodations may be arranged whenever possible.
Assumption of Risk
Guests voluntarily assume all risks incidental to attendance at the Theater, including risks associated with crowds, audience participation, walking surfaces, seating areas, and other ordinary venue-related conditions.
MANDATORY BINDING ARBITRATION AGREEMENT
Dispute Resolution; Waiver of Jury Trial
To the fullest extent permitted by applicable law, any and all claims, disputes, controversies, or causes of action arising out of or relating to Marvyn’s Magic Theater, its performances, events, ticket purchases, services, facilities, employees, agents, or the relationship between the parties, including any claim involving BJJ, LLC, doing business as Marvyn’s Magic Theater (collectively, “Covered Disputes”), shall be resolved exclusively through final and binding arbitration and not through a lawsuit or trial in court.
By agreeing to this provision, the parties expressly waive their right to have Covered Disputes decided by a judge or jury, except as otherwise required by applicable law. Any party asserting a Covered Dispute shall submit the matter to binding arbitration in accordance with the Federal Arbitration Act, 9 U.S.C. § 1 et seq., and the applicable rules of the arbitration provider mutually agreed upon by the parties.
The arbitrator shall have the authority to award any remedy or relief that would otherwise be available in a court of law, subject to applicable law. The arbitration award shall be final and binding upon the parties, and judgment on the award may be entered in any court having jurisdiction.
Nothing in this provision shall prevent BJJ, LLC from seeking temporary, preliminary, or emergency injunctive relief from a court when necessary to preserve the status quo or protect its rights pending arbitration, or from pursuing any other remedy that cannot lawfully be waived.
This arbitration agreement shall survive the termination, expiration, or completion of any transaction, ticket purchase, contract, or relationship to which it applies. If any portion of this provision is determined to be unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.
Lost, Stolen, or Damaged Property
The Theater is not responsible for lost, stolen, or damaged personal property.
Chargebacks and Payment Disputes
Customers agree to contact the Theater first regarding any billing dispute before initiating a chargeback.
Fraudulent, improper, or unsupported chargebacks may result in cancellation of tickets, collection efforts, denial of future purchases, or other remedies available by law.
Limitation of Liability
To the fullest extent permitted by law, Marvyn's Magic Theater, its owners, employees, contractors, performers, affiliates, and representatives shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from attendance at the Theater, participation in any event, use of the website, or purchase of tickets.
The Theater's maximum liability relating to any ticket purchase or customer claim shall not exceed the amount actually paid for the ticket(s) giving rise to the claim.

Magic Show and Entertainment Disclaimer
Marvyn's Magic Theater presents live magic, comedy, variety, and audience-participation entertainment.
Guests acknowledge that audience participation, volunteer involvement, improvisation, humor, surprise, theatrical effects, and performer interaction are inherent components of many presentations.
Participation in any performance activity is entirely voluntary. Guests who choose to participate do so at their own discretion.
The Theater does not guarantee any particular performance content, magical effect, performer, audience experience, or entertainment outcome. Individual reactions and experiences may vary.
No refunds, credits, or exchanges will be provided based solely upon dissatisfaction with the performance, subject matter, humor, magical effects, audience participation, audience interaction, or entertainment value.
Certain performances may contain material intended for mature audiences.
Guests agree that emotional reactions resulting from surprise, astonishment, audience participation, theatrical effects, or entertainment content are inherent aspects of live performance and shall not form the basis of any claim against the Theater.
Website Use
Users agree not to misuse the Theater's website, interfere with its operation, attempt unauthorized access, or use the website for unlawful purposes.
Modifications
The Theater reserves the right to modify these Terms of Service and Conditions at any time. Updated versions shall become effective upon posting to the Theater's website.
Governing Law and Venue
These Terms of Service and Conditions shall be governed by and construed in accordance with the laws of the State of California.
Any dispute arising from these Terms, ticket purchases, website use, or attendance at the Theater shall be brought exclusively in the state or federal courts located in Riverside County, California.
Entire Agreement
These Terms of Service and Conditions, together with the Theater's Privacy Policy and Cookie Policy, constitute the entire agreement between the customer and Marvyn's Magic Theater regarding website use, ticket purchases, and attendance at events.
